News-and-Society NEW DELHI: In Nitish Katara murder case, Shivani Gaur was the last witness, not Ajay Katara.Sukhdev Pehalwan, one of the accused in Nitish Katara murder case, today alleged before the Delhi High Court that the prime witness in case, Ajay Katara was not a ‘chance witness as claimed by prosecution but a ‘bought-up witness whose sole purpose was to give false statement to built circumstantial evidence against the accused. His lawyer Ravinder Kapoor, pointed several inaccuracies in his statements and also on his conducts, making the court to remark whether he was just a ‘drunken fool. Sukhdev Pehalwan, one of the three accused in Nitish Katara murder case, disputed the prosecution case before the Delhi High Court that the last seen witness in the case is Ajay Katara. His lawyer Ravinder Kapoor, citing witness statements, claimed today that the Kataras murder cases time-line establish that the Shivani Gaur, a key witness in case, was the ‘last seen witness.Gaurs statement is extremely crucial for the case, as prosecution had heavily depended to built the entire case against the three accused, Vikas Yadav, Vishal Yadav and Sukhdev. Due to reliability of her deposition, prosecution had put her to examination-in-chief (eic).Quoting from statements of key witnesses, Kapoor argued before Justice Gita Mittal and J.R. Midha that the prosecution case appears to be ‘after-thought as key witnesses statements are contradictory. He said that the cases time line reveal on the fateful day, three key witnesses have seen the accused persons at different point of time. The first were two UP Police constables on a picket duty at night. They claimed to have stopped accused Vikas Yadavs vehicle at around 12.10 am at night. Second was Ajay Katara who claimed to have seen accused and deceased Nitish together at around 12.30 am and third was Shivani who had deposed that Nitish was at the wedding banquet hall till 1:15 am to 1.30 am.Highlighting Shivanis statement, the defence lawyer said that if one goes by three witnesses statements, she qualify to be the ‘last seen witness as per the Evidence Act. However, the prosecution had deliberately ignored her statement and made Ajay to be ‘last seen witness. The last seen witness is one the most important ingredient in the case as prosecution had alleged that Nitish was kidnapped/ abducted from the wedding banquet hall in Ghaziabad on intervening night of Feb 16/17,2002 and later killed by accused Vikas, Vishal and Sukhdev.He also claimed that none of eyewitnesses have disclosed Sukdevs names while making statements before the police under 161 Cr.Pc. No recovery was made on accused disclosure. The prosecution had also not given any motive for accused abducting and killing Nitish. His name is also not mentioned in the First Information Report (FIR). In fact the prosecution in initial case had not mentioned involvement of any ‘third person in the case.
